1. Acceptance and who provides the app

These Terms of Use are an agreement between you and Italo Bandeira, under the iFlag brand, who is responsible for DailyBetter.

By installing, accessing or using the app, you confirm that you have read and accepted these Terms and the Privacy Policy. If you don't agree, don't use DailyBetter.

You must have the legal capacity to accept these Terms. Where the law requires it, minors must use the app with the permission and supervision of a parent or legal guardian.

2. What DailyBetter offers

DailyBetter is a mood journal for Android. It lets you log how you're feeling, add optional information, view your history, calendar and statistics, set reminders and, where available on your device and version, create or restore a backup.

The app can be used without creating a DailyBetter account. When you export a backup, you choose in the Android share sheet where to save the file; choosing Google Drive requires that service to be available and set up on the device.

3. License and rules of use

As long as you comply with these Terms, iFlag grants you a limited, personal, non-exclusive, non-transferable and revocable license to install and use DailyBetter on compatible devices for lawful purposes.

You may not:

• copy, sell, rent, sublicense or distribute the app, except where the law allows it;
• reverse engineer, decompile or try to extract the source code, except to the extent expressly permitted by law;
• circumvent security, advertising or licensing mechanisms or technical limitations;
• use the app to violate rights, commit fraud, insert malicious code or harm the service;
• use DailyBetter's brand, screens, text or other elements as if they were your own.

The app, its brand, code, interface and materials are protected by intellectual property laws. These Terms do not transfer ownership of those elements to you.

4. Ads and a future ad-removal option

DailyBetter is currently offered with ads and has no subscription. Showing ads may depend on internet connection, region, device settings and provider availability.

In the future, we may offer a purchase to remove ads. This is not part of the current offer, and these Terms create no obligation to launch it. If it becomes available, the price, duration of the benefit, requirements and other conditions will be clearly stated before purchase.

In-app purchases, if they exist, may be processed by Google Play and will also be subject to the store's terms. Refunds and cancellations will follow applicable law and the rules shown in the purchase flow. A possible ad-removal purchase will not be a recurring subscription unless this is explicitly stated before purchase and accepted by you.

5. Backup, Google Drive and third-party services

The backup feature is optional and started by you. DailyBetter creates a JSON file in a temporary area and opens the Android share options. The app does not sign in to your Google Account or request direct access to Google Drive. To restore, you select a compatible backup file on the device.

If you choose Google Drive as the destination, uploading and storage depend on Drive, your Google Account, your internet connection and available space. These services are operated by Google and subject to the Google Terms of Service and its Privacy Policy.

DailyBetter may also depend on Android, Google Play and Google services for distribution, ads and technical functions. We don't control the availability, policies or changes of those services.

6. Your entries and your responsibility

You keep the rights to the content you log in DailyBetter. To run the features you choose, you authorize only the technical processing needed on your device and, when you export a backup, the creation of the file and its delivery to the destination you select.

You are responsible for the content you enter, for the security of your device and Google Account, for deciding what you want to log and for keeping backups when you see fit. Don't include unlawful content or third-party data without a legitimate basis.

7. Wellbeing, health and emergencies

DailyBetter is a tool for personal logging and reflection. It does not provide diagnosis, treatment, therapy, or medical or psychological advice, and it is not a substitute for qualified professionals.

Statistics, streaks and patterns shown in the app reflect only the data you logged and may be incomplete. Don't make medical decisions based solely on this information.

If you are in immediate danger or an emergency, contact your local emergency services or someone you trust. DailyBetter is not an emergency channel and does not monitor your entries.

8. Updates and availability

We may fix bugs, change features, change compatibility, update the interface or discontinue parts of DailyBetter. Whenever reasonable, relevant changes will be communicated through the app, the store or this page.

We don't guarantee uninterrupted operation or compatibility with every device and Android version. Some updates may be required to maintain security, compatibility or access to certain features.

9. Warranties and limitation of liability

We take reasonable care to offer DailyBetter safely and functionally. However, the app is made available as per its current version and availability, and may have bugs, interruptions or technical limitations.

To the extent permitted by law, iFlag is not liable for indirect damages resulting from improper use, loss of the device, failures of third-party services, lack of backup or decisions made solely on the basis of the app's entries and statistics.

Nothing in these Terms excludes or limits rights and guarantees that cannot be waived under Brazilian law, including consumer protection rules, nor excludes liability where the law does not allow it.

10. Suspension and termination

You can stop using DailyBetter at any time and uninstall the app. Before that, make a backup if you want to keep your entries.

We may restrict or end access to features when necessary to comply with the law, protect the app's security or respond to a material breach of these Terms. Features that depend on third parties may also stop working by decision of the respective provider.

11. Changes to these Terms

We may update these Terms to reflect changes in DailyBetter, in the law or in the services used. The current version will be published on this page with the updated date.

When a change is material, we may show a notice in the app or through another appropriate channel. If the law requires new agreement, we will ask for it before applying the change.

12. Governing law and disputes

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be submitted to the competent court defined by applicable law, preserving consumer rights, including the court of your domicile where applicable.
